What Evidence Matters Most in a Dram Shop Investigation

Dram Shop cases involve claims that a bar, restaurant, or other establishment served alcohol to an individual who was visibly intoxicated, resulting in injury or damage to another person.

Investigating these cases requires a detailed review of multiple types of evidence.

One of the most important sources of evidence is surveillance footage. Many establishments have security cameras that may capture the patron’s behavior, level of intoxication, and interactions with staff.

Another important element is witness statements. Bartenders, servers, patrons, and security staff may all have relevant information regarding the patron’s condition before leaving the establishment.

Investigators also review point-of-sale records and receipts, which may show how many drinks were served and over what period of time.

Police reports, accident reports, and toxicology results can also provide critical information when determining the timeline of events.

In some cases, investigators may conduct neighborhood canvasses to identify additional witnesses who observed the individual leaving the establishment.

Because Dram Shop cases often depend on proving visible intoxication, documenting evidence as soon as possible is essential.
